Definition of Negligence

Negligence is the failure to act as a reasonable prudent person when we have a duty to avoid negligence. The persons to whom we have such a duty is defined by law.

In Washington the elements of negligence which must be proved are duty, breach of duty, proximate causation, and resulting injury. Alger v. Mukilteo, 107 Wn.2d 541, 545, 730 P.2d 1333 (1987); Hoffer v State of Washington, 110 Wn.2d 415, 422, 755 P.2d 781 (1988).
